As a presidential candidate, Barack Obama deliberately and repeatedly lied to America's 90 million gun owners across the country when he insisted that he would not try to take away anyone's firearms.

The Second Amendment does not stop states and cities from banning guns. This week the Seventh Circuit held that the Second Amendment right to bear arms does not apply to state or city laws. In January, Sotomayor was on a three-judge panel from the Second Circuit that similarly held that the Second Amendment affects only federal law, not state or local law.

During the 1900s, the Supreme Court began applying most of the Bill of Rights (or "incorporating") to the states through the Fourteenth Amendment. Before that time, the Supreme Court had held back in 1876, and again in 1886, that the Second Amendment does not apply to the states. But it never had an occasion to revisit the Second Amendment during the 1900s incorporation cases. It also did not need to do so last year in the Heller case because Washington, D.C. is a federal enclave, not a state, and is therefore directly controlled by the Bill of Rights.

It is almost a certainty that Sotomayor would rule that the Second Amendment affects only federal law, not state or local law. This makes Obama's anti-gun strategy clear - stack the supreme court with liberal anti-gunners and make gun ownership unconstitutional.

"President Obama's gun prohibitionist agenda has fallen on deaf ears on Capitol Hill," said CCRKBA Chairman Alan Gottlieb.

"But now he is picking judicial nominees that will almost certainly legislate from the bench," he continued. "Supreme Court nominee Sonia Sotomayor has already ruled that the Second Amendment does not apply to the states. We've learned that Sotomayor's nomination is supported by ACORN, the publicly-funded anti-gun group that supported a Jersey City gun control ordinance that was struck down by the court.

"Seventy years ago, President Franklin D. Roosevelt tried to stack the Supreme Court to push his social agenda, and he failed," Gottlieb recalled. "President Obama tried to use his cabinet to rally support for a gun ban renewal and he failed, so now he's planning to stack the courts with anti-gun ACORN nominees.

"America has had enough Left-wing judicial activism from the federal bench," he concluded. "In Judge Sotomayor's own words, 'I don't believe we should bend the Constitution under any circumstances. It says what it says. We should do honor to it.' That includes honoring the Second Amendment. It does not include manipulating the courts to accomplish from the bench what cannot be achieved through Congress."

Lautenberg Continues Senate Push To Ban Gun Sales. Lautenberg will likely introduce legislation in the Senate to eliminate the private transfers of firearms and close the nation's "gun show loophole." as an amendment to a different bill as he did in 1999, when Lautenberg successfully passed legislation identical to this bill as an amendment to a juvenile justice bill.

The White House has clearly made a political decision at this time not to push for closing the gun show loophole or the assault weapons ban -- both of which it clearly supports and would gladly sign into law opting instead to stack the courts
